I put in...do I really have to say it..and it wouldn't read it period, the disk drive does its thing but than dies off does its thing again dies off till finally it says the Disk is unrecognizable. WTF MAN I JUST BOUGHT IT TODAY!!!! Oh and it seems to not have the new xbox dashboard either.

Yeah, borrow a game from a friend (oh yeah, just try a DVD) and see if it works. If it does, you'll just have to take your game back and get a replacement. Easier than taking the entire console back without trying.

Electricity and cables are cool things, discs are pretty awesome too... disks not so much.
Anyway, I suggest booting the system without a disc in the drive (as they're set to auto-start games in drive by default), see which dashboard you have (NXE or not, duh!) and then take it online and update (if it's not), and then get back in the action.
Also, just to check; this is not a modded console in any way, is it?
(Like, some messed up iExtreme installation that has bricked your DVD rom or some mod-chip that doesn't like the idea of you updating the dashboard or something)
